1. Who you are agreeing with

Feather Creative, LLC (doing business as "Feather") ("we," "our," or "us") is an independent music and media practice releasing original recordings and creative work. This policy describes how we collect, use, and protect personal data in connection with Feather and the services offered at feather.fm.

By using this site or joining our list, you agree to these terms. If you do not agree, please do not use the site.

2. Your account and the list

Some parts of this site require an account or an access code. Keep your access details to yourself — you are responsible for what happens under your account. You can ask us to close it at any time.

Joining the list is free and you can leave whenever you like. We may close or restrict an account that is being used to abuse the site, other listeners, or us.

3. Our content

The music, artwork, video, writing, and design on this site belong to Feather Creative, LLC or to the people we made them with. You may enjoy and share them as the site allows. You may not reproduce, sell, sample, or redistribute them commercially without written permission.

Anything you send us — messages, submissions, or comments — stays yours, but you give us permission to read it and to respond.

4. Text messaging

4.1 Opt-in and consent

You may opt in to receive SMS messages from Feather in two ways. Web form opt-in: by entering your mobile number and checking the dedicated SMS consent checkbox on our signup form. The checkbox is unchecked by default, is never required to submit the form or as a condition of any purchase, and is displayed together with the specific consent language, a link to this Privacy Policy, and a link to our Terms. Keyword opt-in: by texting CONNECT to our published number. You will then receive a confirmation message identifying Feather, stating that message frequency varies, stating that message and data rates may apply, and providing HELP and STOP instructions.

Consent to marketing messages is never a condition of any purchase.

4.2 Frequency and rates

Message frequency varies with release and show activity. Message and data rates may apply. We do not charge for sending or receiving messages, but your carrier may.

4.3 Help and opt-out

Reply HELP to any message from Feather for information about the program and how to reach us. Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE) to stop receiving further SMS messages. You will receive one confirmation of your opt-out, after which no further marketing or transactional SMS will be sent. To resume, reply START or opt in again through the methods above. You may also contact us at contact@feathercreative.co at any time.

4.4 No third-party sharing

Mobile opt-in consent and mobile phone numbers are not shared with third parties or affiliates for marketing or promotional purposes under any circumstances.

4.5 Your representations

Messages are sent across major U.S. wireless carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages, and delivery is outside our control. The SMS program is available only to individuals in the United States who are at least 13 years of age. You represent that you are the subscriber of the number you provide, or are authorized by the subscriber to opt it in. If you stop being the subscriber of a number you opted in with, please notify us at contact@feathercreative.co so we can remove it.

5. Platform

This site and our list, messaging, and contact tools run on the Common Garden platform, provided by Common Garden LLC, which processes data on our behalf. Text messages are delivered by Twilio, Inc. as a sub-processor. Your use of those tools is also subject to the Common Garden Terms at https://www.cmngrdn.com/terms.

6. Liability

The site is provided as it is. To the fullest extent the law allows, we are not liable for indirect or consequential loss arising from your use of it. Nothing here limits liability that cannot lawfully be limited.

7. Changes

We may update these terms. The effective date above tells you when they last changed, and continued use of the site after that means you accept them.

8. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.
